Angela L. Folino

Angela Folino's primary focus is business litigation. She has represented a variety of clients, ranging from large national corporations to small, privately-held corporations and individuals. Angela works closely with her clients to resolve their disputes in a timely, efficient manner.

Angela's experience includes general commercial and civil litigation, including contract disputes and negligence claims in the areas of pharmacy and PharmaCare, construction and builders' liens, commercial leasing, defamation, employment and real property, among others. Angela has appeared at all levels of court in British Columbia.

Prior to joining KZEL, Angela was a partner at a downtown Vancouver law firm. Angela articled and practiced at the Vancouver office of a national firm. Prior to attending law school, Angela worked for the Ministry of Attorney General, Court Services Branch.

 

Representative Matters:

● Representing pharmacies in disputes with PharmaCare and the College of Pharmacists on matters relating to audits and billing, enrollment, and professional conduct

● Representing owners and contractors in prosecuting and defending builders lien and construction claims

● Representing component manufacturers in defending product liability claims arising out of aircraft collisions

● Representing aircraft maintenance organizations in defending claims of negligence arising out of aircraft collisions

● Co-counsel on a successful application to dismiss a third party claim on the basis that a claim for indemnity could best be achieved by a plea of contributory negligence against the plaintiff: TNR Gold Corp. v. MIM Argentina Exploraciones S.A. , 2011 BCSC 243

● Co-counsel at trial on a successful breach of contract claim that has become the leading authority in Canada on the issue of “economic” force majeure: Domtar Inc. v. Univar Canada Ltd. , 2011 BCSC 1776

● Counsel on a successful judicial review proceeding arising from the Human Rights Tribunal: Yaremy v. British Columbia (Human Rights Tribunal) , 2013 BCSC 2386

● Counsel for a non-profit housing society on a successful judicial review proceeding arising from a decision of the Residential Tenancy Branch: Hu v. Red Door Housing Society , 2016 BCSC 1238

● Counsel for a commercial landlord in a successful commercial lease lawsuit arising from unpaid triple net rent expenses: Bulley v. Weatherford Canada Partnership , 2016 BCSC 1955

● Counsel on a successful petition for a declaration that a mortgage was unenforceable, Chan v. 0975713 B.C. Ltd. , 2018 BCSC 872
